TPI Aspen Forum 2026:The Supreme Court in an Era of Political Polarization

The Supreme Court just completed another contentious Term. Critics call the Court a rubber stamp for the Trump Administration, whereas President Trump himself calls its Justices “fools and lapdogs for the RINOs and the radical left Democrats” when they (sometimes) form majorities against him. This panel will assess the Court’s role in this age of polarization by examining its recent decisions on tariffs, independent agencies, voting rights, and birthright citizenship. The panel will also address recent decisions of particular significance to the tech and telecom industries, including FCC forfeiture authority and contributory copyright. Ian Gershengorn, former Acting Solicitor General of the United States, joins Northwestern law professor James Speta. TPI Nonresident Senior Fellow Jonathan Nuechterlein, former General Counsel of the Federal Trade Commission, moderates.
