While the recent court decision regarding the AT&T/Time Warner merger grabs headlines, other competition issues with longer term consequences continue to percolate. More than 130 competition agencies around the world have jurisdiction over companies that operate globally, and they do not all have the same objectives. Different rules and standards can make operations more difficult for companies that operate globally. The US antitrust regime remains economics-based, with the objectives of preventing practices that harm consumers by protecting the competitive process itself. Other enforcement agencies sometimes take a different approach, such as protecting competitors, rather than competition, per se. As part of its response to this fragmentation, the US Department of Justice hopes to harmonize procedural norms across countries in competition enforcement. This panel will discuss global trends in antitrust enforcement and whose rules and which standards are on the rise.
